As the operators of this website, we take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration. The following declaration gives you an overview of how we guarantee this protection and what kind of data is collected, to what extent and for what purpose. In addition, we intend to inform anyone about their rights.
Using our website is generally possible without giving any personal data. However, if a user wishes to make use of special services provided by vivamind via our website, it may be necessary to process personal data (e. g. name, address or e-mail addresses). If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the individual concerned.
Personal data will not be passed on to third parties without your express consent, unless this is absolutely necessary for the execution of business transactions in order to provide the service or to execute a contract. In that case data will be limited to the minimum required.
We wish to point out that vivamind, as the one who is responsible for the processing of personal data, has implemented various technical and organizational measures in order to ensure that the personal data processed via this website will be protected as completely as possible.
It is impossible to fully protect data from being accessed by third parties because data transmissions on the internet (e. g. when communicating via e-mail) always have security gaps. For this reason, anyone concerned will be free to provide us with personal data by alternative means, for example by telephone or ordninary mail.
This website sometimes uses so-called cookies. Cookies are text files that are stored in the internet browser or on the user’s computer system by the internet browser. When a user accesses a website, a cookie may be stored on the user’s computer. That cookie contains a characteristic string of characters that allows the browser to be uniquely identified when you return to the website.
Most of the cookies used by us are so-called “session cookies”. They are deleted automatically at the end of your visit. Other cookies will be stored on your device until you delete them. These cookies enable us to recognize your browser at the time of your next visit.
The following data is stored and transmitted in thoses cookies.
– pll_language (the choosen language of the page)
Sec. 6 subs. 1 lit. f DSGVO is the legal basis for the processing of personal data using cookies.
Cookies that are necessary technically are used to simplify the use of websites for users.
Server Log Files
The site provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This concerns:
- Browser type and browser version
- Operating system used
- Referrer URL
- IP-address and hostname of the accessing computer
- Date and the time of the server request
Such data cannot be assigned to specific individuals. Such data shall not be merged with other data sources. We reserve the right to check such data at a later date if we become aware of specific indications of illegal use.
Sec. 6 subs. 1 lit. F DSGVO is the legal basis for the temporary storing of data. These log-files will be deleted automatically after 20 days.
The collection of data for the provision of the website and the storage of the data in log files is mandatory for the operation of the website. This means that a user cannot raise any objections to this.
You may contact us using the e-mail address email@example.com. In that case, the personal data of the user transmitted by e-mail will be stored.
No data will be passed on to any third parties in this context. The data will only be used for processing the conversation.
Sec. 6 subs. 1 lit. a DSGVO is the legal basis for the processing of data in the case of consent on the part of the user.
Sec. 6 subs. 1 lit. f DSGVO is the legal basis for the processing of data transmitted while sending an a-mail. If the e-mail contact serves the purpose of concluding a contract, the additional legal basis for the processing of data will be sec. 6 subs. 1 lit. b DSGVO.
In the event of a contact by e-mail, the processing of personal data will only serve the purpose of processing such contact, and this constitutes the necessary legitimate interest in processing the data.
The deletion of the data takes place as soon as they are no longer necessary for the achievement of the purpose of their collection. Here, too, this is the case when the conversation with the user is ended, i.e. when circumstances show that the facts of the matter concerned have been finally clarified.
The additional personal data collected during the sending process will be deleted after a period of 35 days at the latest.
2. Possibility of objection and elimination
The user revoke consent to the processing of personal data at any time. If the user contacts us by e-mail, the user may object to the storage of personal data at any time (see below “Right of information, data transferability, correction, restriction and deletion as well as right of revocation, right of objection and right of complaint, item 6, contact for exercising your rights”). In such a case the conversation cannot be continued.
All personal data that were stored during the contact will then be deleted.
